THE VILLA MARGARET RIVER TERMS AND CONDITIONS

GENERAL REQUIREMENTS

Please read these terms and conditions carefully. It is your responsibility to ensure all the details on your booking confirmation are correct. Guests and visitors must comply with all terms and conditions, by-laws and instructions from The Villa Margaret River during their stay.

BOOKINGS
Bookings can be made at www.thevillamargaretriver.com.au

You agree to pay the rate for each night of your stay and any additional charges up until the time you have departed the accommodation. The accommodation may be occupied by you only for the period stated on the booking confirmation.

PAYMENT POLICY
Full payment is required at time of booking. If payment is not received by the due date The Villa Margaret River reserves the right to cancel the booking.

SECURITY BOND
A security bond of $300 is required at time of booking. Your security bond will be debited in the event of damage to the property, equipment, breakages or if extra cleaning is required.

RATES & CHARGES
Rates quoted are in Australian dollars and are subject to change at any time. Rates are inclusive of GST where applicable. Minimum 2 night stay required. Minimum 3 night stay for long weekends and events. Minimum 5 night stay for Easter, Christmas and New Years Eve. The price and booking cannot be guaranteed until the deposit is received or if booking online full payment is required at time of booking.

CANCELLATION POLICY
Refer to individual booking agents cancellation policies. 

CHILDRENS PRICES
Children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. Children 0-2 years are free of charge.

LEAVERS POLICY
The Villa Margaret River does not accept leavers reservations.

TRAVEL INSURANCE
We highly recommend you purchase comprehensive travel insurance at time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is cancelled; loss or damage to personal baggage and loss of money and medical expenses.

CHECK IN & CHECK OUT
Standard check in time is 3.00pm and accommodation is to be vacated by 10.00 am on the day of departure. An additional fee will be charged if you do not check out by 10.00 am. Early arrivals and late check outs are at the discretion of The Villa Margaret River and must be requested at the time of booking and can only be confirmed 1 day prior to arrival or departure. Whilst every effort will be made to accommodate early arrivals and late departures the only way to absolutely ensure early check-in or late check-out is to book an extra night.

NOISE AND RESIDENTIAL AMENITY
Guests and visitors must not create noise which is offensive to occupiers of neighbouring property especially between 10.00pm – 8.00am and during arrival and departure at any time throughout the occupancy. Offensive noise is prohibited and may result in termination of permission to occupy the property, eviction, loss of rental paid and extra charges for security and other expenses which may be deducted from security bond under these terms and conditions. Guests and visitors must not engage in anti-social behaviour and must minimise their impact upon the residential amenity of neighbours and local community.

COMPLAINTS FROM NEIGHBOURS
Guests must notify us of any disputes or complaints from neighbours as soon as possible.

NUMBER OF GUESTS
At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given by The Villa Margaret River. The use of extra beds other than the number booked will attract an additional tariff. Any persons exceeding the maximum occupancy of the property will be considered trespassers and will be evicted. Extra guests cannot stay and pay for selected nights they will be charged for the duration of the stay. The maximum number of guests permitted at The Villa Margaret River is 6 guests.

VISITORS
Guests are responsible for ensuring the limits set on visitor numbers is complied with at all times and ensuring that visitors comply with these Terms and Conditions.

PERSONAL BELONGINGS
You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupant’s personal property left on the premises and agree that you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.

PARTIES OR GATHERINGS
Parties or gatherings are strictly prohibited. Disturbance to neighbours including excessive noise and music is prohibited and may result in eviction without refund. If a noise complaint is received a first warning will be given, if a second complaint is received this will result in immediate eviction with no refund.

BREAKAGES AND DAMAGES
Upon check out accommodation should be left clean and tidy. Damages or breakages of furniture or furnishings must be reported to us immediately. Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full from your security bond. Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card or deducted from the security bond. 

LOSS OF KEYS
Loss of keys and remote will incur a $50 call out fee & the loss of keys and remote will incur a $100 replacement charge.

PARKING
Guests and visitors are to comply with parking regulations and other requirements and show consideration to neighbours and other vehicles. Parking arrangements are as follows – two undercover car parking spaces at The Villa Margaret River and parking is also available on Ned Higgins Laneway and Townview Terrace. Parking is prohibited in the common driveway area of the complex.

COMMERCIAL USE
The Villa Margaret River is not to be used for commercial use. Photo and location shoots are at an additional cost by prior arrangement.

COUNCIL
The Villa Margaret River is operated to the guidelines of the Local Planning Policy 7 – Short Stay Accommodation set out by the Shire of Augusta Margaret River. All guidelines use be adhered to or can result in eviction from the property.

LIABILITIES
You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions due to electrical storms or other acts of God caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.LIABILITIES

SECURITY
A surveillance camera that can monitor and record is located facing the front door entrance for the safety and security of guests and the premises. 

CHANGES BEYOND OUR CONTROL
Compensation will not apply if a significant change is made for reasons beyond our control. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.

BREACH OF TERMS AND CONDITIONS
Guests and visitors must comply with all terms and conditions, by-laws and instructions from The Villa Margaret River during your stay. You agree that should you, your guests or your visitors breach any of the terms and conditions: You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your security bond in payment of that loss or damage. The Villa Margaret River reserves the right to terminate permission to occupy and to evict from the The Villa Margaret River guests and/or visitors who breach or refuse to follow these terms and conditions.

PRIVACY POLICY
The Villa Margaret River is subject to the National Principles in the Privacy Act 1988. We will collect personal information about you directly from you when you communicate with us over the phone or by email. The type of personal information collected by The Villa Margaret River will include your name, address, telephone number an email address. If you send emails to The Villa Margaret River that contain confidential information, you do so entirely at your own risk.
